Welcome to Fiscape.com, a website operated by Fiscape Publications, LLC (“we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our services, software, and website. By accessing or using Fiscape, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and legally capable of entering into contracts to use Fiscape services. By using our services, you represent that you meet these requirements.

2. Description of Services

Fiscape provides a software platform (“Fiscape Connector”) that allows users to manage their communications—including email, calendar, SMS, and contacts—via third-party services such as Google Workspace, Microsoft Outlook/Graph, and IMAP/SMTP.

3. User Accounts and Membership

To use Fiscape, you must create an account and subscribe to a paid membership plan. Each plan is associated with a specific product and includes access quotas.

  • Your account and membership are personal to you.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • Memberships are managed through Paid Memberships Pro and may be canceled or upgraded through your account dashboard.

4. Data Storage and Privacy

Fiscape does not store the content of your emails, calendar events, contacts, or SMS messages.

We do store the following types of information:

  • Your name, email address, and billing address (for account and subscription purposes)
  • OAuth credentials or login tokens for the third-party services you choose to connect
  • Technical logs and usage data for security and quota enforcement

We do not store or process your credit card number on our servers. All payment processing is handled securely by our third-party provider.

Your data is encrypted in transit and stored securely. We do not sell your data to third parties.

5. Acceptable Use

You agree not to:

  • Use Fiscape to send spam, abusive content, or malware
  • Interfere with or disrupt the functioning of the API or platform
  • Attempt to reverse engineer, decompile, or bypass security measures
  • Use automated scripts or bots to exceed your quota or gain unauthorized access

We reserve the right to suspend or permanently revoke access if we detect abuse, security threats, or any attempts to manipulate or reverse engineer the platform.

6. Third-Party Services

Fiscape is not affiliated with Google, Microsoft, Twilio, or other providers you may connect. Use of those services is governed by their respective Terms of Use and Privacy Policies.

You are solely responsible for maintaining authorization with those platforms. Fiscape is not liable for third-party outages, revocations, or API limitations.

7. Platform Limitations

Fiscape uses official APIs provided by third-party services such as Google Workspace, Microsoft 365, and IMAP/SMTP providers. These APIs may impose functional or technical limitations outside our control.

Known examples include:

  • Google and Microsoft may throttle or temporarily block high-frequency API requests.
  • Google’s Gmail API separates messages and threads; Microsoft Graph does not provide unified thread views.
  • Some metadata (e.g., read/unread status, sender IPs, or full folder context) may be limited depending on the provider.
  • Calendar and contact schemas differ; not all fields are equally supported.
  • OAuth tokens may expire or be revoked by the provider without notice.

Fiscape attempts to normalize these differences, but is not responsible for limitations caused by the provider.

8. Limitation of Liability

To the fullest extent permitted by law, Fiscape and its affiliates disclaim liability for:

  • Loss of access or data due to third-party services
  • Service interruptions
  • Errors caused by invalid credentials, expired tokens, or user misconfiguration
  • Unauthorized access resulting from your failure to secure your account

In no event will our total liability exceed the fees paid by you in the preceding 12 months.

9. Termination

We may suspend or terminate your access to Fiscape services for any of the following reasons:

  • Breach of these Terms
  • Abuse of service limits or security violations
  • Failure to maintain a valid membership or payment method

You may cancel your membership at any time. No refunds are provided unless required by law.

10. Modifications

We reserve the right to update or modify these Terms at any time. Any changes will be posted on this page with the updated effective date. Continued use of the service after such changes constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any disputes will be resolved exclusively in the state or federal courts located in Florida.
